General Terms & Conditions (AGB) for Guided Tours
with Sonja Wagenbrenner in the Würzburg area 2024

In the following terms and conditions you will find provisions on booking, service and group size as well as fees, payment, cancellation and liability. These terms and conditions are the intellectual property of the contractor (= the guide). Copying the content is not allowed!

1. Effectiveness of the General Terms and Conditions (AGB)
In the following terms and conditions, the “customer” is the one who books the tour and the “contractor” is the tourist guide. The customer accepts these terms and conditions with the order. The contract is concluded exclusively on the basis of these terms and conditions of the tourist guide.

2. Booking
The customer receives a written offer after consultation. The contract will be effective only with the confirmation of Sonja Wagenbrenner. The confirmation has to be in writing – by fax or eMail.

3. Services and changes in performance
Type and extent of the contractual services result from the performance description in the order confirmation. Changes, additions or additional agreements require a written confirmation (per fax or e-mail).

If the participants (eg the group of the customer) do not appear on the agreed date, the agreed fee will be charged. In the event of delays of the customer, the tourist guide will be informed by mobile phone, in the event of delays of more than 30 minutes without consultation there is no longer any claim for benefits. A claim for extension of the tour or reduction of the price does not exist for delays. A later ending time than the contractually agreed time is only possible by mutual agreement on the spot. The extended time has to be paid according to the valid fee rate.

In the event of a delay by Sonja Wagenbrenner, the entitlement to benefits and reimbursement will only be maintained by mutual agreement if a similar or equivalent additional program can be offered by the guide. Otherwise the fee will be reduced accordingly.

4. Course of the guided tour
Due to external circumstances (eg major events, weather conditions, demonstrations or similar), the course of a tour can be changed.

In the case of an inside visit, the customer is obliged to follow the instructions of the tourist guide resulting from the respective house rules. Violations can justify the exclusion of group members from the tour.

If due to an unexpected event or special use by the owner or by third parties (eg state visits, baptisms, funeral services etc.) a visit eg in the Würzburg Residence or St. Kilian´s Cathedral can not take place, claims for damages to the contractor are excluded. The agreed guide fee remains valid.

Guided tours at the Würzburg Residence can lead to waiting times – even when booking an own tourist guide. If required, groups of less than 25 persons can be filled with single guests by the palace administration. Please also note the locker duty for bags and the photography ban in the palace.

The tours take place in all weathers. Weather-adapted behavior is requested (rain or sun protection, sturdy shoes without high heels in vineyard tours, adequate supply of water on hot days, etc.).

5. Group size
The maximum number of participants in a guided group tour is 25 people, for only bus tours max. 50 people. If the group size is exceeded, the commissioning of another tourist guide is required. Should – in contrary to the original order – the maximum number of participants be exceeded, the contractor is allowed to charge an additional fee of 5.- Euro per person from the 26th participant on.

6. Fees for guided tours with Sonja Wagenbrenner (valid for 2024)

City and theme tours
German: up to 2 hours 140.- €
Foreign Language: up to 2 hours 150.- €
Each additional hour 40.- €

Trips to the surrounding area (eg Franconian wine country)
Half-day package (up to 5 hours): German: 250.- €, foreign language: 280.- €
Full-day package (up to 9 hours): German: 350.- €, foreign language: 370.- €
Each additional hour 40.- €

These fees do not include VAT, as the contractor is not liable for VAT according to German sales tax law based on § 19 UstG.

Please understand, when requested dates can be optioned only for 2-3 days. Group size is max. 25 people. Entrance fees are not included in the prices.

If the planned duration of a tour is substantially exceeded (15 min. or longer) at the request of the client, a surcharge of 40.- € is due for each started additional hour.

The costs and additional time the guide needs to get to the starting or ending point of a tour outside of Würzburg will be charged extra.

Reservations for restaurants or wine tastings etc. can only be arranged by the guide. To book and pay with the respective companies is the responsibility of the customer him/herself. An exception are champagne tastings with Höfer Sekt. For a wine or champagne tasting during the tour, a price per person will be charged. Prices – depending on the number of participants and wine quality – are available on request.

For the planning of special tours or excursions on request of the customer, a deposit of 50 € can be required. When booking the tour, this amount will be set off with the total fee. If the tour is not booked, the amount will be retained as expense allowance.

7. Payment
The payment for the fee can be made before the contractually agreed date, but at the latest before the start of the tour directly to the contractor without separate request in cash and in full, unless otherwise agreed in writing.

8. Entry fees
Additional fees and entry fees (for museums, etc.) are to be borne by the customer himself and paid for all participants of the group directly at the cash desk.

9. Resignation by the contractor
If for urgent reasons the contractor herself cannot guide the tour, but another tourist guide has to be engaged, this will only be done after prior consultation with the customer, also by phone. If the fulfillment of the contract is endangered, impaired or impossible due to force majeure (such as bad weather, catastrophes, etc.), the contractor may withdraw from the agreed service or cancel it without replacement. An equivalent, modified program is then sought. Compensation of the customer in this case is expressly excluded.

10. Cancellation by the customer

The withdrawal from the contract must be made in writing – by fax, e-mail or post – and is valid from receipt by the contractor (guide). If the cancellation occurs up to and including the fourth day before the agreed date, no compensation will be charged. If a cancellation occurs any later than this, a compensation of 100% will be charged. This does not give the client the right to use the service of the guide at another time. The customer has the right to prove that the contractor has saved significant expenditures with the cancellation. For tours with wine or sparkling wine tastings, in the event of cancellation up to and including the seventh day before the agreed date, a compensation has to be paid of 100.- € flat.

11. Obligations of cooperation of the customer
The customer is to inform the contractor in good time before the start of the tour about peculiarities of the group profile (eg walking disabilities, cardiovascular weakness, participation of children, etc.). If this notice is omitted, the contractor accepts no liability for any necessary performance restrictions.

12. Liability
The liability of the contractor is limited to the fulfillment of the agreed scope of services and is financially limited to the amount of the agreed guide fee. Through her membership in the Würzburg Tourist Guide Association and German National Tourist Guide Association (BVGD) the contractor is insured with a professional liability insurance. This is a group liability and property damage insurance with Generali Versicherung AG, 81731 Munich. Detailed information at www.bvgd.org.

When minors participate in the tour, the contractor is not required to supervise. The supervision remains with the parents, the legal representatives or the accompanying persons.

13. Other rights of the contractor:
Image and sound recordings of the contractor or the content of the guided tour are not permitted.

14. Governing Law
Unless otherwise agreed, German law applies exclusively to the contractual relationship between customer and contractor.

15. Jurisdiction
Jurisdiction is Würzburg in Bavaria (Germany).

16. Severability clause
Should individual clauses of these terms and conditions be ineffective, the remainder shall apply irrespective of this.
